1. Definitions
In these Terms and Conditions:
- "Vesterly", "we", "us", or "our" refers to Vesterly, 22 Montri Road, Talat Yai, Phuket 83000, Thailand.
- "Service" refers to any of our offerings: the Pension Basics Self-Paced Course, the Records Tidy-Up Service, or the Community Information Programme.
- "User" or "you" refers to any individual who accesses our website or engages with a Vesterly service.
- "Content" refers to all course materials, templates, checklists, printed resources, and documents produced by Vesterly.
- "Agreement" means these Terms and Conditions as updated from time to time.
2. Acceptance of Terms
By using our website or engaging any of our services, you confirm that you are aged 18 or over, have the legal capacity to enter into this agreement, and agree to be bound by these Terms and Conditions. If you do not agree, you should not use our website or services.
3. Nature of Our Services
Vesterly provides general education and practical organisational assistance in relation to retirement processes and document management. Our services are educational and informational in nature. We do not provide:
- Personal financial advice or pension planning recommendations
- Legal advice or representation
- Individual case management or representation with official bodies
- Tax advice
Nothing in our content or sessions constitutes professional financial, legal, or tax advice. You remain responsible for your own decisions and any actions you take as a result of engaging with Vesterly's materials.
4. Service Availability
Services are delivered from our Phuket office and, where agreed, at participant locations or community venues within Phuket and nearby areas. Online course access is available to users worldwide. We do not guarantee uninterrupted access to online course materials and will endeavour to resolve any access issues within two working days.
5. User Responsibilities
When using our services, you agree to:
- Provide accurate contact and booking information
- Not reproduce, resell, or distribute Vesterly's materials without written permission
- Use materials for personal or household purposes only
- Not use our services for any unlawful purpose
6. Intellectual Property
All course content, templates, checklists, written materials, and resources produced by Vesterly remain the intellectual property of Vesterly. We grant you a personal, non-exclusive, non-transferable licence to use materials for your own household purposes. You may not copy, publish, or sell our materials without written consent.
7. Payment Terms
Prices are stated in Thai Baht (฿) and are as follows:
- Pension Basics Self-Paced Course — ฿3,500 per enrolment
- Records Tidy-Up Service — ฿13,000 per session
- Community Information Programme — ฿29,500 per session
Payment is due prior to service delivery. We accept bank transfer and other methods as communicated at the time of booking. Prices are subject to change; quoted prices are valid for 30 days from the date of quotation.
8. Cancellation and Refunds
- Pension Basics Course: Access may be cancelled within 7 days of purchase for a full refund, provided no course materials have been downloaded. After this period, no refund is available.
- Records Tidy-Up Service: Cancellations made more than 48 hours before a scheduled session will receive a full refund. Cancellations within 48 hours may incur a rebooking fee of ฿2,500.
- Community Programme: Cancellations more than 7 days in advance receive a full refund. Within 7 days, a 50% cancellation charge applies to cover preparation costs.
9. Records Tidy-Up — Specific Terms
During a Records Tidy-Up session, we handle only documents you present directly. We do not retain copies of, photograph, or transmit any documents. You remain in control of your documents at all times. We accept no liability for decisions made based on the categorisation of documents during a session.
10. Disclaimers
Our services and content are provided on an "as is" basis for educational purposes. We make no claims about the completeness or applicability of our content to your individual situation, as pension rules and processes vary by country and change over time. We do not make any representations about outcomes that may result from engaging with our services.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Vesterly's liability to you in connection with any service is limited to the amount you paid for that service. We are not liable for indirect, consequential, or incidental losses arising from your use of our services or materials.
12. Indemnification
You agree to indemnify and hold Vesterly harmless from any claims, losses, or expenses arising from your misuse of our services or materials, or from any breach of these Terms and Conditions.
13. Termination
Either party may terminate an agreement for services by giving written notice. In the event of breach, Vesterly may terminate access to online course materials immediately. Refund terms in clause 8 apply. Provisions that by their nature survive termination (including intellectual property and liability clauses) continue to apply.
14. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any disputes arising will first be subject to good-faith negotiation between the parties. If unresolved, disputes will be submitted to the jurisdiction of the courts of Phuket Province, Thailand.
15. General Provisions
- Entire agreement: These Terms and Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Vesterly.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision does not constitute a waiver of future enforcement.
- Assignment: You may not assign your rights under these Terms. Vesterly may assign its obligations in connection with a business transfer.
16. Changes to These Terms
We may update these Terms and Conditions from time to time. The date at the top indicates the last revision. Continued use of our website or services after any changes constitutes acceptance of the revised terms. Material changes will be notified via our website.
